Bankruptcy Pre-filing Counseling Disclosures

Thank you for choosing Clearpoint Credit Counseling Solutions (“Clearpoint”) to help you. Before we can continue, you will need to provide Clearpoint with confirmation that you have read and understand the disclosures listed below. If this is to be a joint session, the secondary person must provide confirmation as well.

After receiving confirmation, we can begin to review your financial situation and then provide you with a summary of your counseling session along with advice and recommendations.

Bankruptcy Pre-filing Counseling Disclosures

  • For the pre-filing bankruptcy counseling and certificate of completion you will be charged a fee. No individual will be refused counseling if they demonstrate the inability to pay, due to income level or hardship.
  • Residents of Arizona, California, Delaware, Illinois, Indiana, Kentucky, Maryland, Massachusetts, Michigan, Nevada, New Jersey, Ohio, Pennsylvania, Texas, Washington and West Virginia are assessed a $20.00 fee to cover our costs. Residents of all other states are assessed a $50 fee. Based on arrangements we may have with your attorney, your fee could be $20 per household. This represents a discount of $30 from our ordinary fee of $50. If you paid your attorney more than $20 please contact your attorney for a refund.
  • It is our practice to waive fees for clients whose income is less than 150% of the Federal Poverty Guidelines, as determined by the Federal Register by the U.S. Department of Health, or if you receive assistance from legal aid.
  • In order to be considered for a fee waiver, click the link on the following page indicating you would like to apply for a fee waiver and provide the documentation as requested. Not everyone who applies for the fee waiver is automatically eligible. Eligibility is based on income verification and ability to pay is based on documentation provided by you.
  • Clients, on their own or through Clearpoint’s services, have the right to negotiate an alternative payment schedule with regard to each unsecured consumer debt.
  • Clearpoint provides bankruptcy pre-filing counseling in English and Spanish; for other languages clients are referred to another agency for assistance.
  • Support for Clearpoint comes from a variety of sources including corporations, foundations, individuals, clients, creditors and partners. Clearpoint does not pay or receive referral fees of any kind, except under a fair share agreement. Our budget, credit and housing counseling services explore alternatives such as bankruptcy and debt management programs. Some of these options and filing for bankruptcy may negatively affect your credit report. Clearpoint is approved to issue certificates in compliance with the Bankruptcy Code. Approval does not endorse or assure the quality of an Agency’s services.
  • Our counselors and educators are certified by the National Foundation for Credit Counseling. Clearpoint will not disclose your identifiable information unless it is required to provide services for you which were directed by you or as required by law, such as is response to a subpoena or to the United States Trustee for investigation of complaints, during on-site visits, or during quality of service reviews. Your certificate will be provided promptly upon successful completion of the online counseling session. Please keep in mind that you and your attorney are responsible for filing the certificate with the court in a timely manner.
  • The United States Trustee has only reviewed Clearpoint’s credit counseling services and its services as a provider of personal financial management instructional courses. The United States Trustee has neither reviewed nor approved any other services the agency provides to clients.
